About these terms

These terms of service ("Terms") govern your use of Still Here, including the mobile app and our website. By downloading, installing, or using Still Here, you accept these Terms in full. If you do not agree to these Terms, do not use Still Here.

The service

Still Here is a daily check-in tool that sends SMS alerts to emergency contacts you have chosen if you miss your scheduled check-in.

Important: Still Here is not an emergency service. We do not contact emergency services, hospitals, or any official authorities on your behalf. We only notify the contacts you have chosen. What they do with that information is entirely up to them. Still Here also:

  • Does not track or share your location
  • Is not a medical device or substitute for professional care
  • Does not guarantee any particular outcome or response from your contacts
  • Should not be your sole safety measure

Your responsibilities

When you use Still Here, you agree to provide accurate, complete, and truthful information about yourself and your emergency contacts. You agree to:

  • Keep your emergency contact information up to date. If any contact cannot or should not be contacted for alerts, you must update this immediately.
  • Inform your emergency contacts that you have selected them, and explain what Still Here does and does not do.
  • Not rely on Still Here as your sole method of ensuring your safety or the safety of others.
  • Comply with all applicable laws and regulations.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of income, revenue, profits, or data, arising out of or in connection with your use of Still Here, whether based on warranty, contract, tort, strict liability, or any other legal theory.

We do not guarantee that Still Here will always be available, error-free, or secure. We do not guarantee that alerts will be sent, delivered, or acted upon. You use Still Here entirely at your own risk.

Account termination

We may suspend or terminate your account at any time, without notice, if we believe you have violated these Terms or used Still Here inappropriately. You may delete your account at any time through the app. Upon termination or deletion, your data will be deleted within 30 days.

Changes to these terms

We may update these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, by email or through the app. Your continued use of Still Here after any changes constitutes your acceptance of the new Terms.

Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to any conflict of law principles. Any legal action or proceeding related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
